DMCA Policy Guidelines
GamingVPN does not condone the use of our service to facilitate copyright infringement. We respect and abide by U.S. copyright laws including the requirements of the Digital Millennium Copyright Act ("DMCA") and rely on our users to do the same.
GamingVPN implements a zero-knowledge virtual private network ("VPN") service. Our service is fully automated and we do not log our user's activities. We do not in any way select the recipients our users transmit to or the material our users access while using our service. We do not store, access, or modify any content that our users access while using our service.
As a result, GamingVPN's VPN service qualifies as a provider of transitory digital network communications under 17 U.S.C. § 512(a) of the Copyright Act. As we do not store any content accessed by our users, we are unable to delete any such content that may be infringing. Because we do not log our users' activities in order to protect and respect their privacy, we are unable to identify particular users that may be infringing the lawful copyrights of others.

To file a copyright infringement notification with our designated agent, please complete the form below:
We will review all infringement notifications that substantially comply with Section 512 (c)(3) of the Digital Millennium Copyright Act. If your notice fails to substantially comply with all of these requirements, we may not be able respond to your notice. We will make reasonable attempts to assist the complaining party, recognizing that GamingVPN maintains no records of our users' activities, nor store, access, or modify any content our users access while using our service.
Please be aware that pursuant to 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing or that that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by a service provider, who is injured by such misrepresentation, as the result of the service provider relying upon such misrepresentation in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.
Counter-NoticeShould GamingVPN be able to identify the alleged copyright infringer as one of its users, GamingVPN will abide by the DMCA's counter-notification provision. Specifically, the DMCA provides a means for those reported for copyright infringement using a DMCA notice to provide a response to address the original Complaint. 17 U.S.C. §§ 512(g)(2)-(3).
GamingVPN users that receive a copyright infringement notice may send written communication that includes substantially the following:
- Sufficient information to identify you, including name, address, telephone number, and e-mail address.
- A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the complaining party who the provided notification of claimed infringement to which your notice relates or an agent of such person.
- The following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
Written counter-notification of responses to the claimed copyright infringement must be sent to our Designated Agent as follows:

Upon receipt of any counter notifications that substantially comply with the requirements above, we may forward it to the party who submitted the original complaint notice. Such correspondence may include some of your personal information, such as your name and contact information and by submitting a counter notification, you consent to having your information revealed in this way. We do not forward the counter notification to any party other than the original claimant unless required or expressly permitted to do so by law.
Repeat InfringersGamingVPN complies with copyright laws by terminating repeat infringers of copyrighted content from its service. If you are a copyright owner or agent thereof and you are aware of a repeat infringer of your content using the GamingVPN service, you may provide us with sufficient information to assist us in identifying the user. To the extent we can confirm the claims of repeat infringing activity then we will terminate the user's GamingVPN account.
